FORMOFADROP is a trade name of Fidgets and Digits, a sole proprietorship registered in the Netherlands.

These Terms and this Privacy Policy apply to formofadrop.com and to all agreements, bookings and purchases made through this website.

Terms & Conditions

1. Scope

These Terms apply to every request, booking and purchase made through formofadrop.com: webinars, courses, one-to-one sessions, workshops, seminars and lectures (together: Programs), and fine-art prints, works, editions and objects (together: Editions). By completing an order or booking, you accept these Terms. Specific terms stated with an individual Program or Edition take precedence where they differ.

2. Requests and bookings

• Free webinars: Registration is free. Access links are sent by email. Places may be limited.
• On request (one-to-one sessions, seminars, lectures): Sending an inquiry form creates no binding commitment. An agreement is formed only when both parties confirm a proposal in writing by email.
• Courses and workshops: An agreement is formed once payment is completed through the website checkout.
• Format and language: Seminars, lectures and workshops are given in English, unless agreed otherwise in writing. Any interpretation is arranged and paid for by the client.
• Age: Programs are open to participants aged 18 and older, unless agreed otherwise in writing.

3. Prices and payment

• Prices are in euros (€) and include Dutch BTW (VAT) where applicable.
• Prices marked “On request” are agreed individually in writing before the service is delivered.
• Online payments are processed by Mollie (iDEAL | Wero, credit/debit card, Apple Pay, PayPal, Bancontact, KBC/CBC and bank transfer). FORMOFADROP does not store or have access to your full card or bank details.
• Invoices for agreed Programs are payable within 14 calendar days of the invoice date, unless stated otherwise.

4. Right of withdrawal (consumers)

As a consumer in the EU, you may cancel an online order within 14 days without giving a reason. By law, this right is limited in the following cases:

• Events on a specific date: Leisure activities scheduled for a specific date or period, such as announced workshops or live lectures, are exempt from the right of withdrawal.
• Services started early: If you ask for a service to start within the 14 days, you pay for the part already delivered when you withdraw. Once the service is fully delivered, the right of withdrawal ends.
• Digital content: For downloads, streams or recordings, the right of withdrawal ends when access begins, provided you agreed to immediate access and acknowledged that you lose this right.
• Made-to-order Editions: Works, prints or framing made to your measurements, finish or personal wishes cannot be returned.

To withdraw, send a clear statement by email to official@formofadrop.com with your order details. Refunds are made within 14 days via the original payment method.

5. Rescheduling and cancellation

• Cancellation by you: For paid workshops or courses outside the statutory withdrawal right: cancellation 30 days or more before the start is refunded minus a €25 administration fee; between 29 and 8 days before, 50% is refunded; within 7 days of the start, no refund is given, but you may send another eligible person in your place after written notice.
• Cancellation by FORMOFADROP: If a Program is cancelled or rescheduled, you choose between the new date and a full refund. Costs such as travel or accommodation are not reimbursed.

6. Editions: production, delivery and returns

• Colour: Every effort is made to show editions accurately. Slight differences in colour, tone and saturation between a screen and a pigment print are inherent to fine-art printing and are not a defect.
• Delivery: Works are packed with archival care, insured and shipped within the period stated with the item.
• Returns: Non-customised Editions may be returned within 14 calendar days of receipt, in their original condition and original protective packaging. Return shipping and insurance are at the buyer’s cost.
• Refunds: Refunds, including the original standard shipping cost, are made within 14 days of receiving the return or proof of shipment. A deduction may apply for loss of value caused by handling beyond what is needed to examine the item.
• Transit damage: Report visible damage by email with photographs within 48 hours of receipt, and keep all packaging for the courier.
• Certificates: Certificates of Authenticity and edition numbers are part of the work and must accompany any return.

7. Intellectual property

All texts, concepts, photographs, images, video material and the method Form of a Drop / Confindimism, as published on formofadrop.com or used in Programs, are the intellectual property of oL Stein / FORMOFADROP and protected by Dutch and international copyright law.

• Buying an Edition transfers ownership of the physical object; enrolling in a Program gives a personal study licence. Neither transfers copyright, reproduction or distribution rights.
• Reproducing, publishing, modifying or selling the material, or using the methods to train others, requires prior written permission.

8. Conduct and recording

• Participants may not record, stream or capture audio or video of online or in-person sessions without permission.
• If FORMOFADROP records a session, participants are told in advance. Those who do not want to appear can keep their camera off.
• Photographs or video of participants or models are made and published only with their separate, written consent.
• Disruptive, abusive or discriminatory behaviour allows the organiser to end a participant’s attendance without refund.

9. Liability

To the extent permitted by Dutch law, FORMOFADROP’s liability for any claim arising from a booking or purchase is limited to the price paid for the Program or Edition concerned. FORMOFADROP is not liable for indirect or consequential damage, or for interruptions of third-party hosting, telecommunication or payment services. Nothing in these Terms limits liability for gross negligence (grove schuld) or intent (opzet).

10. Complaints

Send complaints to official@formofadrop.com. You receive a reply within 14 days; if more time is needed, you are told when to expect a full answer.

11. Applicable law

Dutch law applies to all agreements under these Terms. Disputes are submitted to the competent court in the Netherlands, without limiting the mandatory rights consumers have under the law of their country of residence.

Privacy Policy

FORMOFADROP processes only the data needed to answer requests, run Programs and deliver orders. Personal data is never sold or used for advertising or profiling.

Under the General Data Protection Regulation (GDPR/AVG), Fidgets and Digits is the controller of your personal data.

2. What is collected, and on what legal ground

Form answers are sent by email to FORMOFADROP and are not stored in the website’s database.

3. Service providers and international transfers

Personal data is handled only by the service providers needed to run the site and deliver orders:

• Hosting and email: GreenGeeks (servers in Amsterdam, the Netherlands).
• Outgoing email relay: MailChannels (USA).
• Payments: Mollie B.V. (the Netherlands), which also acts as an independent controller for its own legal obligations as a payment institution.
• Email and backup storage: Google (Gmail and Google Drive), for receiving form notifications and storing website backups.
• Video (planned): Vimeo (USA), for private webinar recordings.

Where data is transferred outside the EU, this is based on the EU–US Data Privacy Framework or the European Commission’s Standard Contractual Clauses.

4. Retention

• Inquiries that lead to no agreement: up to 12 months after the last contact, then deleted.
• Agreements, orders and invoices: 7 years, as required by Dutch tax law (fiscale bewaarplicht).
• User accounts: until you close your account or ask for deletion.
• Newsletter: until you unsubscribe.
• Security logs: deleted regularly, at the latest after 90 days.
• Website backups: a rolling set covering at most the last 30 days.

5. Cookies and browser storage

This site uses only functional cookies and browser storage needed for it to work:

• keeping your shopping cart and checkout session;
• keeping you logged in;
• remembering interface choices, such as a dismissed pop-up.

There are no analytics, advertising or social-media trackers, so no cookie consent banner is needed. Fonts are served from this site’s own server.

6. Your rights

You may ask to access, correct or delete your personal data, to restrict its use, to receive it in a portable format, or object to its processing. Consent can be withdrawn at any time; every newsletter contains an unsubscribe link.

Send requests to official@formofadrop.com. You receive an answer within one month. You also have the right to file a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens.

7. Minors

Programs and model requests are for people aged 18 and older. Data of minors is not knowingly collected, except with the written consent of a parent or legal guardian.

8. Security

The site uses an encrypted connection (HTTPS), protection against login attacks, and regular offsite backups. Access to personal data is restricted to FORMOFADROP.

9. Changes

This page may change when the site or the law changes. The date at the top shows the current version.
